Terms of Service

Effective date: 24 March 2026

These Terms of Service (“Terms”) govern your access to and use of CMS One (“the Service”) operated by CMS One (“we”, “us”, or “our”). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Who May Use the Service

CMS One is a publicly available SaaS platform. Any individual who is at least 16 years of age may register for an account. By registering, you represent that the information you provide is accurate and that you have the legal capacity to enter into a binding agreement.

You must not share your login credentials with any other person. You are responsible for all activity carried out under your account. If you believe your credentials have been compromised, you must change your password immediately and notify us at support@cmsone.app.

2. Account Registration & Workspaces

When you register, a personal workspace is automatically created for you. You become the owner and administrator of that workspace with full control over its settings, content, and team members. As a workspace administrator you may:

  • Create and manage multiple websites under your workspace
  • Invite team members and assign them roles within your workspace
  • Publish, schedule, and manage blog posts, portfolio pieces, and other content
  • Configure custom domains, themes, and workspace settings
  • Generate API keys for external integrations
  • Set up webhooks to connect with third-party services

Invited team members receive access scoped to the permissions granted by the workspace administrator and may not exceed those permissions.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Post, upload, or publish content that is unlawful, defamatory, abusive, obscene, or otherwise objectionable
  • Infringe the intellectual property rights, privacy, or other legal rights of any third party
  • Distribute spam, malware, viruses, or any harmful or destructive code via the Service
  • Attempt to gain unauthorised access to any part of the Service, another user's workspace, or any connected system
  • Circumvent, disable, or interfere with security-related features of the Service
  • Use automated scripts, bots, or crawlers to scrape or interact with the Service without prior written permission
  • Resell, sublicense, or otherwise commercialise access to the Service without our express written consent
  • Use the Service in a way that could damage, disable, overburden, or impair its infrastructure

4. Content Ownership & Licence

You retain full ownership of all content you create, upload, or publish through the Service (“Your Content”). We do not claim any ownership rights over Your Content.

By uploading or publishing content through the Service, you grant CMS One a limited, non-exclusive, royalty-free licence to store, display, and deliver Your Content solely to the extent necessary to provide the Service to you and your team.

You are solely responsible for Your Content and for ensuring that it does not violate any applicable law or third-party rights. We reserve the right to remove any content that we reasonably believe violates these Terms or applicable law.

5. API Usage & Third-Party Integrations

CMS One provides a RESTful API for programmatic access to your workspace content. API access is authenticated using API keys which you may generate from your account settings. You are responsible for keeping your API keys confidential.

  • API keys grant access to your workspace data and must not be shared publicly or committed to source control
  • You must revoke compromised keys immediately from your account settings
  • Automated API usage must not exceed reasonable request rate limits
  • We reserve the right to throttle or suspend API access that negatively impacts service performance

The Service may integrate with third-party platforms (e.g. OAuth providers such as Google, GitHub, and Microsoft). Your use of those integrations is also governed by the respective third-party terms of service.

6. Intellectual Property

The Service, including all software, design, UI components, branding, and underlying infrastructure, is the intellectual property of CMS One or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for its intended purpose during the period your account remains active. This licence does not permit you to copy, modify, distribute, reverse-engineer, or create derivative works of any part of the Service.

7. Privacy & Data Protection

Your privacy is important to us. Our Privacy Policy explains what personal data we collect, how we use it, how long we retain it, and your rights regarding that data. By using the Service, you acknowledge that your personal data is processed in accordance with our Privacy Policy.

8. Service Availability & Changes

We strive to keep CMS One available at all times but do not guarantee uninterrupted access. Scheduled and unscheduled maintenance may result in temporary unavailability. We will make reasonable efforts to communicate planned downtime in advance.

We reserve the right to modify, update, or discontinue features of the Service at any time. Where changes materially affect your use of the Service, we will provide reasonable notice via email or through the platform.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be error-free, uninterrupted, secure, or free from viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, CMS One shall not be liable for any indirect, incidental, special, or consequential losses arising from your use of the Service, including but not limited to:

  • Loss of content, data, or access resulting from account termination or service interruption
  • Loss of revenue, profits, or business opportunities arising from reliance on the Service
  • Unauthorised access to or alteration of your content or data by a third party
  • Any errors, bugs, or inaccuracies in the Service

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited.

11. Suspension & Termination

You may close your account at any time from your account settings. Upon account closure, your workspace and all associated content will be scheduled for deletion in accordance with our data retention policy.

We reserve the right to suspend or terminate your account immediately and without prior notice if we reasonably believe you have:

  • Breached any provision of these Terms
  • Engaged in fraudulent, abusive, or otherwise harmful conduct
  • Used the Service in a way that poses a security or legal risk to us or other users

Termination does not affect any rights or obligations that arose prior to termination. Sections 4, 6, 9, 10, and 13 survive termination of these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute arising from or in connection with these Terms or your use of the Service shall be resolved through good-faith negotiation before any legal proceedings are initiated.

13. Changes to These Terms

We may update these Terms from time to time. The “Effective date” at the top of this page indicates when the current version was last updated. Your continued use of the Service after any update constitutes your acceptance of the revised Terms. Where changes are material, we will provide advance notice via email or through the Service.
